Pate, Dugard, and Cameron Win Writ of Mandate in CEQA Case Leading to Dismissal in its Entirety of Challenge to College Project

October 16, 2009

Partners William Pate, Prescilla Dugard and associate Christina Cameron successfully argued against a Petition for Writ of Mandate. Petitioner filed suit against the City of San Diego and the San Diego Community College District challenging the District’s Mesa College Street Vacation and East Entry Parking Garage. Petitioners claimed the parking garage impacted City park land and that the project had not received proper environmental review under the California Environmental Quality Act (CEQA). Offering an extensive administrative record, Mr. Pate, Ms. Dugard, and Ms. Cameron defended the allegations under CEQA. The Petition was denied by the Court. This denial resulted in the subsequent dismissal of all remaining causes of action, disposing of the case in its entirety.
