Shinoff and Carelli Successfully Defend Against Religious Discrimination Suit

Partners Daniel R. Shinoff and Paul V. Carelli successfully defended the Lemon Grove School District and its employees in a case involving a former middle-school dance instructor who alleged religious discrimination. Plaintiff Kathy Villalobos alleged that her contract with the School District to provide after-school dance classes was wrongfully terminated, and that she was fired solely because she played religious music in her dance classes. The East County jury did not agree, and submitted a 12-0 verdict against Villalobos. The jury found that Villalobos did not meet her contractual obligations to the School District, and that the School District did not discriminate against her. The judge additionally found that the School District did not violate the Education Code statute regarding the use of religious materials in the classroom.
