Titus Wins Mandatory Injunction Upholding "Unobstructed View" Restriction

Robert Titus succeeded in obtaining a mandatory injunction for his homeowner client. In a case entitled Petty v. Hill in San Diego Superior Court, Mr. Titus argued successfully that a 1968 Declaration of Restrictions afforded his client's upper-level cul-de-sac residence an unobstructed view of the Bay. Mr. Titus won a mandatory injunction whereby the second story of a home, which obstructed his client's view, had to be removed.
