Holtz Wins Motion for Summary Judgment in Wrongful Death Case

Jim Holtz won a Motion for Summary Judgment for a general contractor in a wrongful death case with a milti-million dollar award potential. The accident arose out of a construction site grading operation where two men were killed when they raised a service crane into a power line. The Court commented that, although it was a tragic accident, the oral argument and briefing were persuasive that the general contractor owed no legal duty to the employees of the subcontractor who remained in control of the work, and there was no evidence the owner of the general contractor affirmatively contributed to the unsafe practices that caused the accident.
